At one point Thursday, the condition of the NFL labor talks -- or at least the perception of them -- had frayed to the point where word was the dispute could be "going back to the courts." Then some dirty work by U.S. Magistrate Judge Arthur Boylan led to a late-night negotiation session that went until 1 a.m. CT. First, there clearly is a deal to be done between these parties, because if there wasn't, then reasons to continue talking after five weeks would have dwindled. Second, that hardly means that deal will be done in time to beat the clock on saving the preseason, which means the parties remain in a very precarious spot with plenty of work left to be done. The negotiations continue Tuesday morning in Manhattan. Legal teams and staff from each party, in addition to NFL Commissioner Roger Goodell and NFL Players Association executive director DeMaurice Smith, are set to talk Tuesday and Wednesday. They'll be joined by owners and players Thursday and Friday. And it appears that now, finally, the parties locked in a battle that has produced a fourth-month-old lockout are arriving at the 11th hour. The reason why lies in the money that would be lost with the cancellation of the preseason. The owners project the number to be close to $1 billion. The players say that number is inflated. Either way, no preseason means a significant chunk will Premier Aaron Rodgers Jersey be taken out of the revenue pie, which the owners and players have proven unable to divvy up throughout this whole process. Asked if it's likely that would affect the owners' offer to the players, one management source said: "No, not likely. It's automatic." What has happened up to this point can be addressed. But the real damage is coming -- and coming fast -- which is why the next two weeks are critical. The good news is that the parties left last week's talks seemingly ready to return this week in deal-making mode. Boylan's efforts helped the parties come a lot closer on the revenue split, to the point where it's not nearly the issue it was last Monday or Thursday, and reach a real definition of "all revenue" in the "all revenue" model. Indications are that many of the "fringe" terms -- ideas pushed by one party and found unacceptable by the other (i.e. sneaking cost credits back in by owners, or players asking sales tax be part of "all revenue") -- were coming off the table by the time the parties left Minneapolis on Friday. But there's still significant work to do, and a recognition that the process needs speed up, and it needs to speed up now. Negotiations toward a labor deal that would end the N.F.L. lockout were confronted with a new hurdle Monday when the group of retired players involved in the antitrust lawsuit against the league — angered because they say their interests and representatives are being shut out by both sides in the talks — filed a separate complaint against players and owners. The class-action complaint was filed in Federal District Court in Minneapolis against the teams, the league, the players named in the Brady v. N.F.L. lawsuit and DeMaurice Smith, the head of the N.F.L. Players Association. It asserted that the sides were violating antitrust laws by negotiating settlement terms that improperly encompassed the rights of retired players in the time since the N.F.L.P.A. renounced its union status. The complaint says that the current players and the association, with the N.F.L., “are conspiring to depress the amounts of Authentic Ziggy Hood Jersey pension and disability benefits to be paid to former N.F.L. players in order to maximize the salaries and benefits to current N.F.L. players.” And it says that while the N.F.L. is willing to commit additional money to retirees from within and outside the league’s salary cap, the union “has insisted that the sum within the salary cap be given to current players instead.” “We feel we have a seat at the table, but we’re having the chair pulled out from under us,” said Michael Hausfeld, the Washington-based lawyer representing retired players. “Both sides are saying, ‘We’ll decide what’s in your best interests.’ ” Whether the complaint could throw a wrench into negotiations that are to resume Tuesday in New York will be determined by the court. It would first have to decide if retired players have standing to bring an antitrust complaint, because they are not active participants in the marketplace of the N.F.L. The complaint seeks an injunction to halt discussions between the league and current players related to retiree issues, and it asks for a declaration that the players association cannot represent the interests of retired players in settlement or prosecution of the antitrust suit. The league estimates that it will lose $200 million in revenue for each week that preseason games are missed, money that would be part of the salary cap in a new deal. Retired players have grown increasingly frustrated in recent weeks that their benefits have not been addressed as negotiators have pressed to complete a deal to end the lockout. Parts of the complaint underscore the fissures between retired and current players, some of which have simmered for years. Although the group of retired players filed its own lawsuit, which was combined by District Court with the Brady suit, representatives for retired players have not been involved in Jets Darrelle Revis Jersey the most recent negotiations, which began in early June, despite public statements by current players and the league that they intend to provide improved disability and pension benefits for retired players in the new labor agreement. Retired players were persuaded to file the complaint when lawyers for current players balked at setting aside money inside the salary cap — money that is allocated annual revenue for current players — for retired player benefits, arguing that anything inside the cap should belong to current players only. The league has offered $320 million outside the salary cap — from the total revenue pool the league would contribute that would not come out of current players’ designated annual revenue share — and $320 million inside the salary cap. That would be a total of $640 million for the 10-year deal, or about $64 million a year toward future retiree benefits.
